On July 25, 2016, the VA issued a class deviation amending its procurement regulations in light of the Kingdomware decision. The Supreme Court in that case ruled that the VA must award all orders on the FSS Schedule to SDVOSBs unless the rule of two cannot be met. The VA Acquisition Regulations now reflect this requirement in FSS orders, as well as in other contract vehicles. To justify not awarding to an SDVOSB, the Contracting Officer must document the record with market research concluding that there are not at least two SDVOSBs likely to compete for the requirement.
